Lee entered into a contract with Hairston Enterprises, Inc. (Hairston) for the construction and sale of a house. During construction Lee noticed that there was a water leak in the garage adjacent to the house. During various phases of construction, Hairston assured Lee that the leak would be fixed; however, the problem persisted after completion of the house and after the closing.
