Defendant Billy Shiu Yan Yee moves for an order dismissing the indictment against him in the interests of justice, pursuant to CPL 210.20 (subd 1, par [i]) and 210.40, and on the ground that the prosecution of the indictment is barred by reason of a previous prosecution, pursuant to CPL 210.20 (subd 1, par [e]) and 40.20.
