The plaintiff, a tenant in an apartment subject to Brookline's rental control and eviction by-laws, appeals from an order of the Appellate Division of the District Court Department dismissing a report in an eviction proceeding. The Brookline rent control board (board) had determined that the plaintiff's landlord, Babcock Street Associates Trust (landlord), was entitled to a certificate of eviction
