Cashin, Jr., was indicted on September 24, 1981, by the Madison County Grand Jury on six counts of theft of property in the first degree in violation of § 13A-8-3 Code of Alabama (1975). Appellant was arraigned on April 12, 1982, at which time the State moved to amend the charges to theft in the second degree.
