Plaintiff's decedent died as the result of fatal injuries sustained when the automobile he was driving on West Street in Manhattan struck a support column of the elevated "West Side Highway" at the intersection of West and Laight Streets on March 3, 1972 at approximately 8:30 P.M. The postmortem autopsy report, which was stipulated into evidence by the parties, indicated that decedent's blood contained .25% ethyl alcohol. The support pillar which decedent struck was not painted...
