The accident giving rise to this action occurred in West Germany while plaintiff was driving a BMW automobile he had purchased in New York for delivery to him in Munich under an arrangement called the European delivery plan. The car was delivered to plaintiff by the manufacturer BMW-AG, a corporation existing under the laws of the Federal Republic of Germany.
