DAUGHERTY, District Judge.

Defendant/Movant (hereafter movant) was indicted by the grand jury in this district on November 1, 1978, on a charge of Bank Robbery in violation of the provisions of 18 U.S.C. §§ 2113(a) and 2113(d). After trial by jury, movant was convicted of violating the provisions of 18 U.S.C. § 2113(a), the § 2113(d) charge having been dismissed on motion of the government, and he was subsequently sentenced...
