Daniel Morris Thomas, a state prisoner under a sentence of death and a warrant for the execution of such sentence, moved the court in which he was tried and sentenced, under Florida Rule of Criminal Procedure 3.850, for an order vacating the judgment and sentence.* He also asked for a stay of execution pending the disposition of the motion.
