This action is brought pursuant to the Age Discrimination in Employment Act of 1967, as amended, 29 U.S.C. § 621 et seq. Jurisdiction is founded upon the provisions of 29 U.S.C. § 626(c).1 Before this Court is defendant's application, pursuant to Rule 65, Fed.R.Civ.P., for a preliminary injunction.
