In this case, the defendants challenge the Keene District Court's practice of initiating contempt proceedings against judgment debtors by the issuance of a writ of capias.

In January 1981, the plaintiff, Vermont National Bank, brought suit against the defendants to collect money owed. That suit was concluded on February 25, 1981, when both parties entered into an agreement which read as follows:
