McHUGH, Justice:

This action is before this Court upon the appeal of Bill Harshbarger from his 1979 conviction in the Circuit Court of Cabell County, West Virginia, of the offense of delivery of marihuana. As a result of that conviction he was sentenced to the West Virginia Penitentiary for a period of not less than one year nor more than five years.
