The plaintiff (Zilberman) brought an action in tort for negligence against the defendant Gordon's Liquor, Inc. (Gordon), the owner of a package store located in Waltham. Zilberman alleged, and the jury found, that Gordon negligently sold beer to a minor, Thomas Thoele, who, as a result of drinking that beer, negligently drove his car so that it struck and injured her husband, David Zilberman.
