The plaintiff, J. R. West, seeks to rescind the sale of a 1954 Chevrolet truck with a fuel tank mounted thereon, and to obtain judgment for damages in the sum of $70,000 and attorneys' fees in the sum of $8,000. The defendant, Charles Klumpp, was the auctioneer at the sale to plaintiff.
