A jury verdict of $750,000 was rendered in favor of plaintiff Terry Muilenberg1 in this products liability action. The action stemmed from plaintiff's ingestion of a drug, Cleocin, produced and distributed by defendant Upjohn Company. The theories of the case were failure to warn of the drug's side effects and negligence by Upjohn in the pretesting of the drug.

On July 22, 1971, plaintiff went to Dr. Harrell, a dermatologist...
