This appeal involves a charge of a different crime after the speedy-trial period had elapsed on an original charge.

On August 7, 1979, two men kicked open the door of the home of Mr. and Mrs. Paul Lord and robbed them. One of the men was defendant Robert Wayne Eichorn. The other man was armed with a gun.
