TYSON, Judge.

Henry Gaines filed a Petition for Writ of Habeas Corpus in the Circuit Court of Escambia County, asserting that he was in the care and custody of the Alabama State Penal Authorities, being held at Fountain Correctional Center. Gaines asserted that his continued imprisonment was in violation of "due process of law" in that he had not been afforded a "parole hearing" which he maintained should have been held on or about July 25, 1981.
