This is an appeal from a jury verdict finding the defendant, Robert E. Scott, guilty of burglary in violation of Neb.Rev. Stat. § 28-507 (Reissue 1979). The defendant was also found to be an habitual criminal as defined in Neb.Rev.Stat. § 29-2221 (Reissue 1979). After overruling a motion for new trial, the court sentenced the defendant to an indeterminate sentence of not less than 10 years nor more than 20 years at hard labor in the Nebraska...
