We granted GEICO's application for certiorari in order to review the Court of Appeals' holding in Gingold v. Government Employees Ins. Co., 159 Ga.App. 410 (283 S.E.2d 614) (1981), that genuine issues of material fact exist in respondent Gingold's excess liability action. The trial court had reached a contrary conclusion.
