(1) Defendant Logan Construction Company, Inc., is a Pennsylvania corporation engaged in the construction business.

(2) In September of 1977, Logan entered into a contract with the Borough of Renovo for the construction of a dam at the Paddy's Run Reservoir to be completed by November 24, 1978.
