ARMSTRONG, J.

Reuben Green, who died on September 5, 1978, played viola in the Boston Symphony Orchestra. The year before his death he was divorced from his first wife and entered into a stipulation, which was merged in the divorce judgment, by which he undertook to maintain in effect certain insurance policies on his life and to maintain the children of the first marriage as the beneficiaries under those policies.
