This matter comes before the court upon appeal of Carmen's Restaurant, Inc., t/a Carmen's Country Inn, from a failure of the Pennsylvania Liquor Control Board to grant a restaurant liquor license for said Carmen's Country Inn. The reasons for the refusal are:

"1. As provided by law, Butler Township, Luzerne County, has a quota of 2 licenses for the retail sale of alcoholic beverages and there are 11 restaurant liquor...
