Appellant Larry Patton was indicted for the felony of manufacturing and possessing with intent to manufacture marijuana in violation of W.Va.Code, 60A-4-401 [1971]. He was convicted by a jury in the Circuit Court of Braxton County and sentenced to a term of one to five years in the penitentiary.
