Plaintiff-appellant, Emmanuel Evans ("Evans"), sued Occidental Life Insurance Company of North Carolina ("Occidental") to collect $30,000 of life insurance claimed payable to him as beneficiary under a policy on the life of Evans' wife, Evelyn L.
