This is an appeal from a judgment of conviction and sentence of the defendant-appellant by the Court of Common Pleas of Union County for four counts of gross sexual imposition. The defendant had been originally indicted by the grand jury for ten offenses. At the commencement of trial the prosecutor moved to nolle prosequi Counts 1, 7 and 10. At the close of the state's case in chief three counts, 2, 5 and 6, alleging rape were dismissed by the court...
