Defendant Daniel L. Kelley appeals of right his jury conviction of the offense of aggravated assault, MCL 750.81a; MSA 28.276(1).

Defendant was charged with, and tried for, assault with intent to do great bodily harm less than murder, MCL 750.84; MSA 28.279, which bears a maximum penalty of ten years imprisonment.
