OPINION

SMITH, J.

Russell Fridley appeals from a judgment denying his petition for a peremptory writ of mandate. Appellant had sought the writ to compel respondents, the Secretary of State of California and the Registrar of Voters of Santa Clara County, to place his name on the general election ballot of November 4, 1980, as a candidate of the Libertarian Party for the office of state assemblyman for the 22d district.
