UTTER, J.

The trial court declared RCW 39.16 violated U.S. Const. art. 4, § 2, the privileges and immunities clause. The matter is on direct review to this court. We affirm.

RCW 39.16.005 provides in pertinent part:

In all contracts let by the state ... or any county, city ... for the erection, construction, alteration, demolition, or repair of any public building ... or any other kind of public work or improvement, the contractor or subcontractor...
