Defendant Gene Tunnie Favors was charged with first-degree criminal sexual conduct and convicted by jury of assault with intent to commit criminal sexual conduct involving penetration, MCL 750.520g(1); MSA 28.788(7)(1). He was sentenced to a term of six years, eight months to ten years in prison and appeals as of right.

The complainant, Lasonia Bey, was nine years old at the time of the offense...
