This is an action for breach of a written contract. According to the terms of the contract, the plaintiff was to perform painting and repair work on two houses, located at 130 and 130 1/2 Newbury St., Lawrence, Massachusetts.
The contract provided that "Workmen's Compensation and Public Liability Insurance is carried by the Company (plaintiff) and applicable to the work to be performed under the contract."
