OPINION BY PRESIDENT JUDGE CRUMLISH, JR., January 14, 1982:

Chestnut Hill Enterprises, Inc. (Chestnut Hill) appeals from an order of the Court of Common Pleas of Lackawanna County sustaining the preliminary objections of the Borough of Mayfield directed at Chestnut Hill's petition for appointment of viewers pursuant to the provisions of Section 502(e) of the Eminent Domain Code.1
