On September 9, 1977, appellants, Michael and Virginia Pippin, contracted with Kern-Ward Building Co. for the purchase of a newly to be constructed home. Continental Federal Savings and Loan Co. (formerly Cleveland Federal) provided financing and agreed to act as escrow agent for the closing.
