Defendant-appellant, Alfred David Costa (hereinafter appellant), appeals from an order of the First Circuit Court, entered in favor of the State of Hawaii, which denied appellant's motion to withdraw his plea of guilty. At issue is whether the terms of the plea agreement entered into by the State and appellant were breached by the State's filing a motion for mandatory imprisonment.
