This is an action brought by Nazario Morales, a former employee of defendant Plaxall, Inc. ("Plaxall"), to recover employment benefits allegedly due under defendant's profit sharing plan ("the Plan"), which was established under the Employee Retirement Income Security Act ("ERISA"), 29 U.S.C. §§ 1001-1461.
