OPINION

EDWARD WEINFELD, District Judge.

Petitioner, convicted of manslaughter in the first degree upon a jury verdict entered in the Supreme Court of the State of New York, Queens County, and now serving a sentence of 6-18 years, petitions for his release upon a federal writ of habeas corpus pursuant to 28 U.S.C., section 2254. The judgment of conviction was affirmed by the Appellate Division and leave to appeal to the Court of Appeals was denied.
