This civil rights action has been brought pursuant to 42 U.S.C. § 1983 by Paulo Arruda ("Arruda"), who currently is incarcerated at the Massachusetts Correctional Institution at Walpole (MCI-Walpole). The defendants are Michael V. Fair ("Fair"), the Commissioner of the Massachusetts Department of Corrections, and Joseph H. Ponte, the Superintendent of MCI-Walpole.
