This is an appeal from the Court of Common Pleas of Cuyahoga County in which the city of Cleveland (hereinafter "appellant"), contests the judgment of the trial court ordering appellant to furnish appellees, Joseph V. Wade et al., the use permit sought for continued operation of his auto repair business. The facts giving rise to this appeal are essentially as follows:
