Bizzigotti appeals the circuit court's dismissal of his petition for writ of mandamus1 for failure to state a cause of action. We have determined that the petition discloses improper action by the Florida Parole and Probation Commission in its use of aggravating factors to extend appellant's presumptive parole release date (PPRD). We reverse.
