The question posed by this interlocutory appeal is whether the Circuit Court of the Second Circuit can entertain a suit for damages resulting from the allegedly unlawful termination of Plaintiff-appellee Robert P. Gouveia's employment by Napili-Kai, Ltd., an employer subject to the National Labor Relations Act. Since Gouveia's complaint avers the discharge stemmed from an attempt to engage in collective bargaining with the employer and federal law...
