Petitioner Eliot Heifetz instituted a special proceeding in the New York State Supreme Court, Kings County, pursuant to CPLR § 7510 by an application to confirm an arbitrator's award granted on April 19, 1982. On May 3, 1982, respondent Irving Tugendrajch removed that petition to this court pursuant to 28 U.S.C. § 1446 and 28 U.S.C. § 1332.
