Appellant Brian Miller and his codefendant were charged with conspiracy to possess with intent to distribute marijuana in violation of 21 U.S.C. § 846 and with possession with intent to distribute marijuana in violation of 21 U.S.C. § 841(a)(1) and 18 U.S.C. § 2. Following the presentation of evidence and argument by counsel, the district court denied appellant's motion to suppress the marijuana which formed the basis of the indictments...
