ROVIRA, Justice.

The Pueblo County Department of Social Services (Pueblo Social Services) and the Colorado State Hospital (psychiatric hospital) appeal1 a judgment of the District Court in and for the County of Pueblo holding that section 27-10-103(3), C.R.S. 1973,2 was unconstitutional. We affirm.
