On May 14, 1980, defendant entered a convenience food store, selected two bottles of wine and a 12-pack of beer, and placed his selections on the check-out counter. After leaving the store for a moment, defendant returned, picked up one of the bottles of wine, and threw it. The bottle of wine hit a customer on his hip.
