Russell was charged in a three-count bill of indictment with aggravated rape, armed robbery, and aggravated burglary, violations of LSA-R.S. 14:42, 14:64, and 14:60, respectively. On April 13-16, 1981, he was tried by a jury of twelve persons and was found guilty of the responsive verdict of forcible rape on Count One, and guilty as charged...
