MEMORANDUM OPINION AND ORDER

SOFAER, District Judge:

On April 23, 1981 a grand jury in this district issued a subpoena duces tecum calling on the witness in this proceeding to produce certain pocket diaries and desk calendars. The witness refused to comply and was held in contempt by Judge Palmieri. Sanction was stayed pending appeal of the witness' fifth-amendment claims to the Second Circuit Court of Appeals.
