In this mortgage foreclosure action, defendant, Oscar S. Wyatt, Jr., appeals from an order of the trial court granting the motion of plaintiff, George P. Jouflas, to appoint a receiver pursuant to C.A.R. 1(a)(4). Wyatt contends that Jouflas impermissibly filed a new motion after a previous motion requesting the appointment of a receiver had been denied ten months earlier, and that the court abused its discretion in granting the motion to appoint.
