This is an appeal from a conviction for murder, where the right to trial by jury was waived. Upon the finding of guilt, the trial court assessed punishment at 40 years confinement in the Texas Department of Corrections. Appellant advances two grounds of error: (1) that the indictment underlying his conviction is fundamentally defective;1 and, (2) that the evidence is insufficient to support the finding...
