BILLINGS, Justice.

The plaintiff, John S. Savo, Jr., appeals from an order of the Chittenden Superior Court granting summary judgment for the defendant, Commissioner of Corrections. The plaintiff's suit sought declaratory and injunctive relief requiring the defendant to give the plaintiff credit towards his prison sentence for time spent in custody between February 7, 1977, and February 26, 1980.
