Plaintiff Peter Lewis initiated this action on March 16, 1981 seeking a declaratory judgment, under 28 U.S.C. § 2201 and Rule 57 of the Federal Rules of Civil Procedure, that he was a "victim" within the meaning of the Pennsylvania No-Fault Motor Vehicle Insurance Act1 and, thus, was entitled to statutory benefits from Defendant, his automobile insurance carrier.
