MEMORANDUM OPINION

RICHARD L. WILLIAMS, District Judge.

This matter comes before the court on respondent's motion to dismiss petitioner's petition for a writ of habeas corpus under 28 U.S.C. § 2254. For reasons given below, respondents' motion is granted.
