On February 11, 1980, plaintiff Jack Cummings applied to defendant Prudential Insurance Company [Prudential] for health care insurance. A question on the application required the plaintiff to disclose other health care insurance coverage. In response, plaintiff listed only a Life of Georgia policy. At that time, however, he was also covered by a second Life of Georgia policy, two Independent Life and Accident Insurance Company...
